What if Talwars are innocent? Talwars vow to nail Aarushi killers
The problem is : CBI and the court system will easily force the manipulation of justice system into finding Talwars guilty. Fact is : No one knows the truth other than Talwars themselves. Evidences were destryed by the inefficiency of Police in the murder scene. What if Talwars are really innocent?
The Supreme Court Thursday ruled that Rajesh and Nupur Talwar would have to face trial in the twin murders of their daughter Aarushi and domestic help Hemraj. This was expected given the state of Indian criminal justice system where an alleged criminal is a criminal because CBI and police ''think'' so and the judges just follow the law enforcements'' whims and political need to find someone guilty or not guilty. The court order prompted the "deeply disappointed" dentist couple to vow that they would nail the killers and that justice would one day prevail.
As the Supreme Court bench of Justices A.K. Patnaik and J.S. Khehar rejected Nupur Talwar's petition seeking review of the earlier order that she and her husband be tried for the 2008 murders and also turned down the plea for further investigation in the case, legal experts said proving innocence in court was now their only option.
While Nupur Talwar is at the Dasna jail in Ghaziabad, Rajesh Talwar is out on bail.
The irony of Indian justice system is that if al all Rajesh Talwar is the murderer and Nupur is just a silent spectator. Nupur was sent to jail by CBI becuase she refused to testify against her husband and made CBI and Indian law enforcement unhappy. There is a proverm in America and India - never make a cop unhappy, he or sghe can make your life hell bacuse the 'system'' grants these cops to take the law in their own hand.
How will any Indian as a citizen of a democratic country accept the verdict ''guilty'' knowing very well that there was no way prove to their guilt except forcing the justice system 'show'' they are guilty?
The Indian court cautioned Nupur Talwar to desist from wasting the time of the court by challenging every order of the lower court right up to apex court. The court said that failure to do so would invite exemplary costs.
"As of now, I would only seriously caution the petitioner from such behaviour in future. After all, frivolous litigation takes up a large chunk of precious court time," Justice Khehar said.
It can also be seen as Nupur Talwar is being threatened by this judge and the court system after being blackmailed by CBI to accept every whims of the law enforce and "Systems'' extreme wish to punish the couple without any real proof.
"We will defend our honour and that of our only child, Aarushi, vigorously in court and we will not rest till all our innocence is proved, our honour vindicated and the real killers are apprehended and brought to trial," the couple said.
The criminal justice system of any ''civilized'' society is based on assuming a person ''not guilty'' till proven beyond any reasonable doubt.
In American and Indian system the criminal justice system is genuinely flawed. The system is tuned is such a way that law enforcement including cops, prosecutors, and judges work together to mentally torture the alleged offender to make them succumb to accepting some form of a guilt even though they can be innocent.
